1 About these Terms and Conditions

1.1 The Individual Customer (“Customer”) as identified on the attached Schedule of Service and Agreement for the Provision of Telecommunication Service to
Individual Customers (“Schedule of Service and Agreement”) is requested to read these Standard Terms and Conditions for the Provision of Telecommunication Service to Individual Customers (“Terms and Conditions”) carefully before making an application for and accepting delivery of the telecommunications service (“Service”) from Link Japan Careers Inc. (“LJC”). The Customer’s acceptance and use of the Service depend on their acceptance and compliance with these Terms and Conditions.

1.2 LJC, at its sole discretion, reserves the right to decline to offer an Application for Service, an offer of a Schedule of Service and Agreement, or the provision of Service to anyone without reason before the Schedule of Service and Agreement is signed by the Customer and accepted by LJC, even in situations where the Customer has made a prior reservation.

1.3 By making an application for and accepting delivery of the Service, the Customer agrees to be bound by these Terms and Conditions. If the Customer disagrees
with any part of these Terms and Conditions, the Customer should not use this Service.

1.4 The latest version of these Terms and Conditions is made available by LJC for review by the Customer at the time that the Customer completes the Application for Service Schedule of Service and Agreements will be delivered electronically (to your email address) and signed using Adobe Sign. An electronic signature, or e-signature, is a legal way to get consent or approval on electronic documents or forms. They are legal, tested, secure, auditable, and verifiable. Once complete, a copy of the signed document will be sent to you by email for safe keeping—you may choose to print it, download it, or leave it stored amongst your emails.

1.5 LJC may from time to time update the standard set of Terms and Conditions. Unless LJC provides specific notice to amend this version of the Terms and
Conditions to the Customer, this version of the Terms and Conditions shall endure for the duration of the Service Period. The Customer, therefore, acknowledges that this version of the Terms and Conditions may differ from versions published by LJC in the future.

2 Definitions

2.1 Unless otherwise stated, the following words have the following meanings:

2.1.1 “LJC” refers to Link Japan Careers Inc. headquartered at GINZA SIX 12F, Ginza 6-10-1, Chuo-ku, Tokyo.

2.1.2 “Service” refers to the mobile communications service, device or equipment provided by LJC as specified on the Schedule of Service and Agreement.

2.1.3 “Service Period” as specified on the Schedule of Service and Agreement, is the period in which LJC provides the Service to the Customer. The dates
specified are inclusive. In certain circumstances, the Service Period may be determined or limited by the Period of Stay associated with the Customer’s Status of Residence in Japan.

2.1.4 “Device” refers to the communications device or equipment and its accessories where applicable (package, charger, manual, etc.) as specified on the
Schedule of Service and Agreement.

2.1.5 “Plan” refers to the Data Packet Communication Plan (expressed in gigabytes) usually provided as part of the Service as specified on the Schedule of
Service and Agreement.

2.1.6 “Monthly Price” refers to the price per calendar month the Customer must pay LJC for the Service as specified on the Schedule of Service and
Agreement. The Monthly Price includes, unless otherwise stated, the cost of the regular Service and Plan, but excludes Additional Charges.

2.1.7 “Additional Charges” refers to any charge incurred by the Customer over and above the Monthly Price either for additional services, communications activity, breaching a prohibited matter, repair or replacement of devices or for changes to or cancellation of the Schedule of Service and Agreement.

2.1.8 “Provider” refers to SoftBank Corporation, a major Japanese telecommunications company, unless otherwise stated.


3 Details of Service

3.1 The details of the Service, Plan, Service Period, Monthly Price, Additional Charges and payment method are described separately on the Schedule of Service
and Agreement provided to and signed by the Customer.

4 Customer Qualification

4.1 To become a Customer, the Customer must be at least 20 years of age and complete at the request of LJC an Application for Service to formally request Service from LJC. The Application for Service will request the Customer to provide information such as their full name (as shown on their Residence Card or Japanese Passport), date of birth, nationality/region of origin, email address, residential address in Japan, employer, emergency or alternative contact information (usually next of kin), and the specification of the Service they are requesting. The Application for Service is in addition to and replaces any information, order or reservation previously provided by the Customer.

4.2 To support the Application for Service and to verify its contents, the Customer must at a minimum provide to LJC a valid Residence Card issued by the
Government of Japan in the case of a foreign national or a Japanese Passport in the case of a Japanese national. In both cases the Customer permits LJC to make and retain a copy, to verify.


4.2.1 The Customer’s full name, date of birth, and nationality/region of origin and that it matches the information provided on the Application for Service.

4.2.2 The Customer has a Status of Residence which allows employment in Japan or is a Japanese national.

4.2.3 The Customer has a Period of Stay which includes, at least, the Service Period as specified in the Schedule of Service and Agreement or is a Japanese national and is not subject to a Period of Stay.

4.2.4 The Customer has a residential address in Japan. Where the Customer has recently arrived in Japan and is yet to have their residential address printed on their Residence Card, LJC at its discretion may allow the Customer up to 14 days to provide an updated copy of the front and back side of their Residence Card.

4.2.5 In the case of a Japanese national, instead of a Residence Card issued only to foreign nationals, the Customer must provide another form of identification to prove the Customer has a residential address in Japan. Where the Customer has recently arrived in Japan and is yet to be issued with another form of identification with their residential address printed on, LJC at its discretion may allow the Customer up to 10 days to provide an updated copy of the alternative form of identification.

4.3 To continue to be a Customer throughout the Service Period, the Customer must notify LJC within 7 days of the issue of a new/replacement Residence Card or any changes to the details printed on the Residence Card including address, Status of Residence, or Period of Stay. The Customer shall provide a copy of the front and back side of their Residence Card to LJC.

4.4 LJC reserves the right to request evidence from the Customer at any time during the Service Period to verify the Customer’s continued qualification. LJC may ask the Customer to provide a copy of the front and back side of their Residence Card or another such document.

4.5 Where LJC determines that the Customer does not meet the criteria mentioned above, LJC may at its sole discretion decline the Application for Service.

4.6 During the Service Period, if LJC determines that the Customer no longer meets the criteria mentioned above, discovers falsified Customer details, or if any communications sent to the Customer by post or email cannot be delivered, LJC may elect to suspend the Service or cancel the Schedule of Service and Agreement by following the procedures as specified elsewhere in these Terms and Conditions, including charging the Customer an Additional Charge for cancellation.

5 Use and Management of Service

5.1 Sub-rental, sub-lease, resale, or use as collateral of the Service by the Customer to a third party or similar transaction is prohibited. Responsibility for the use and management of the Service lies solely with the Customer. Even in situations where the use of the Service is not by the Customer, the responsibility and consequences for such use shall be entirely that of the Customer including the Monthly Price and all Additional Charges incurred.

5.2 It is the responsibility of the Customer to protect their personal information and data from loss by securing their Service (e.g., passcode on Devices) and ensuring the responsible use of Service. The Customer is advised to ensure their personal information and data is regularly backed up to a facility external to the Service. LJC or the Provider shall not be responsible for any personal information and data loss under any circumstances.

6 Care of Service and Device

6.1 Unless otherwise stated, any Device provided as part of the Service is loaned to the Customer by LJC and remains the property of LJC. The Customer must return any Device to LJC when requested. Failure to return any Device (including accessories such as package, charger, manual, etc.) when requested by LJC may incur an Additional Charge.

6.2 LJC may at any time during the Service Period elect to replace or upgrade any Device due to but not limited to a Provider or manufacturer recall, or the age of Device indicating the need for replacement. The replacement Device shall be of an equal or better specification to the original it is replacing. If a replacement or upgrade is needed, any required change to the Schedule of Service and Agreement shall be in favor of the Customer until the end of the Service Period.

6.3 The Customer is prohibited to alter the condition of the Device from the state in which it was received, such as by disassemble or reassembly, painting or affixing stickers, modifying the firmware or operating system by methods such as hacking, cracking, or rooting etc., or a similar act. Where the Device contains some type of software or operating system, the Customer is permitted to and shall install in a timely manner any periodic system updates provided by the manufacturer of the Device to ensure optimal Device performance and security. Any exceptions to this shall be specified in the Schedule of Service and Agreement.

6.4 The Customer is prohibited from removing or altering any labels, such as identification labels, fixed to the Device by LJC.

6.5 The Customer shall only use the provided Devices with other Devices or accessories that are indicated as compatible either by the Device or accessory manufacturer and only by the instructions for use. Accessories and Devices include, but are not limited to, handsets, cables, chargers, cases, and display protectors.

6.6 The Customer is responsible for the Monthly Price and Additional Charges of the Service during periods of Device loss, repair or replacement. The Customer is also responsible for any Additional Charges associated with the repair or replacement of the Device as specified in the Schedule of Service and Agreement, except in the case of Device malfunction.

6.7 The Customer, under any circumstance, is prohibited from performing repairs to malfunctioning or damaged Devices, or procuring the services of a third-party to perform such repairs, even when the third-party is the Device manufacturer or recognized repair provider. In cases where it is found that repairs have been made by the Customer or a third-party, it will be considered that the Customer caused intentional damage to the Device, which may, at the sole discretion of LJC, result in Additional Charges.

6.8 In cases where the Customer experiences Device malfunction, the Customer shall notify LJC by the communication methods specified in the Schedule of Service and Agreement, and LJC will arrange within five working days a replacement Device to be provided to the Customer without Additional Charge. The Customer must return the original Device by the instructions given by LJC. LJC, in conjunction with the Provider, will determine after inspection the nature of the Device malfunction. Where it is determined that the malfunction was caused by intentional or accidental damage or destruction, an Additional Charge will be incurred.

6.9 The Customer shall exercise reasonable care to avoid the theft, loss or intentional damage of the Device. Upon discovering the theft, loss or intentional damage of the Device, the Customer shall notify LJC by the communication methods specified in the Schedule of Service and Agreement and report the theft, loss or intentional damage of the Device to the police station with jurisdiction over the area where the Customer believes the theft, loss or intentional damage occurred. After reporting the theft, loss or intentional damage of the Device to the police station, the Customer shall provide LJC with a report issued by the police station. All notifications to LJC and the police station must happen without delay.

6.10 The Customer shall exercise reasonable care to avoid accidental damage or destruction of the Device. Upon discovering the accidental damage or destruction of
the Device, the Customer shall notify LJC by the communication methods specified in the Schedule of Service and Agreement. All notifications to LJC must happen without delay.

6.11 In cases where the Device is confiscated by the police or other administrative institution for the prevention or investigation of crimes, the Customer (or their
representative) shall notify LJC by the communication methods specified in the Schedule of Service and Agreement. All notifications to LJC must happen without delay. If after 15 days from the date of confiscation, the Device is not returned to the possession of the Customer, LJC may at its sole discretion cancel the Schedule of Service and Agreement per the provisions for cancellation as specified elsewhere in these Terms and Conditions, provide instructions on how to return the Device, and charge Additional Charges as specified in the Schedule of Service and Agreement.

6.12 LJC and the Customer acknowledge that the circumstances regarding Device loss, damage or destruction are highly variable, and where a procedure is not in place to handle that specific circumstance, both LJC and the Customer shall cooperate in good faith to agree on a resolution to restore the regular Service.





7 Prohibited Actions

7.1 The Schedule of Service and Agreement stipulates any specifically prohibited actions that are unique to the Service in addition to any described in any part of these Terms and Conditions.

7.2 It is the responsibility of the Customer to understand what actions are prohibited and comply. There may be instances where although the action is prohibited, it is still technically achievable by the Customer. In cases of non-compliance, the Customer shall be responsible for all consequences, penalties, and Additional Charges arising from the prohibited action.

8 Provision of Customer Support for Service

8.1 LJC shall provide a response to the Customer’s request for support for the Service by the communication methods and during the time periods specified in the Schedule of Service and Agreement. LJC shall endeavor to provide an initial response to the Customer’s communication within 5 business days.

9 Service Performance

9.1 Delivery method is used by the Provider to maintain a regular level of service on the Provider’s network. There may be times or locations where there is either permanently or temporarily no network connection, a weak or inconsistent network connection, or slower data speeds.

9.2 The Provider’s network coverage area is provisioned on a best effort basis prioritizing populated areas of Japan. There may be instances due to natural disasters, emergencies, terrain, obstructions, or such like which means there is no network connection.

9.3 The Provider may temporarily adjust without notice the data speed of any User whom they deem to be heavy users to maintain their network quality and stability.

9.4 In cases where the Customer is using Services in conjunction with their own Device or accessory (that is, a Device or accessory not provided as part of the Service from LJC), LJC provides no initial or ongoing guarantees as to the full or partial compatibility of the provided Service with the Customer’s own Device or accessory.

10 Activity, Monthly Price, and Additional Charges

10.1 The Schedule of Service and Agreement stipulates what Service is made available to the Customer and the Monthly Price. The Schedule of Service and Agreement may also stipulate what Service is available optionally to the Customer for an Additional Charge. The Schedule of Service and Agreement may not stipulate the Additional Charges incurred for activities which are not permitted.

10.2 The Schedule of Service and Agreement may specify as part of the Service a Plan related to data. Data allowances are provisioned on a calendar month basis with the data inallowance resetting on the first day of the calendar month. Unused portions of the data allowance are not carried over to the next calendar month’s data allowance. The Customer is aware that it is their responsibility to use this monthly data allowance responsibly.

10.3 If the Customer exceeds the data allowance for the calendar month, the data transfer speed shall be reduced or the data transfer suspended for the remainder of the calendar month. Unless specified in the Schedule of Service and Agreement, there is no option for the Customer to purchase an additional data allowance.

10.4 The Customer is aware that software and applications on a Device may periodically conduct automatic data transmissions, and that all data transmissions regardless of whether they are the result of automatic transmissions, count towards the data allowance for the calendar month.

10.5 The Customer is aware that they may receive no notice or request for consent before taking action such as those above which may incur Additional Charges. LJC shall provide the Customer with notice of Additional Charges due as soon as possible before the payment due date.

11 Payment

11.1 The Schedule of Service and Agreement specifies the Monthly Price, timing and method(s) of payment by the Customer to LJC.

11.2 It is the responsibility of the Customer to follow the instructions given by LJC related to the setup of the method(s) of payment.

11.3 It is the responsibility of the Customer to make payment in full and on time in accordance with the Schedule of Service and Agreement, and where this is not possible to do this, the Customer must provide notice to LJC in advance. Where Convenience store bill payment or similar service is used to make the payment.

11.4 Where Convenience store bill payment or similar service is used to make the payment, but the payment is unsuccessful, LJC shall notify the Customer as soon as possible and provide instructions to the Customer on methods to forward the overdue payment. The Customer shall be responsible for any Additional Charges imposed by the payment provider for unsuccessful payment or additional attempts to collect payment. The Customer shall also be responsible for any Additional Charges associated with making the late payment by alternative methods.

11.5 In cases where LJC has not received the payment from the Customer on the due date, even if alternative arrangements for payment are made, from one day after the original due date LJC reserves the right to suspend the Service until the Customer makes payment in full. Suspension of Service does not mean the cancellation of the Schedule of Service and Agreement and the Customer shall continue to incur the Monthly Price and Additional Charges where applicable.

11.6 In cases of non-payment after 30 days from the due date, LJC shall deem the Customer delinquent, and LJC reserves the right to contact the emergency or
alternative contact or employer listed on the Application for Service to seek their assistance with the arrangement of payment. When LJC cannot make successful contact with the emergency or alternative contact or employer, LJC reserves the right to make a reasonable effort to establish contact with the delinquent Customer or an associate. LJC also reserves the right to report the non-payment or delinquency to the Provider.

11.7 When a Customer is deemed delinquent, the Schedule of Service and Agreement shall be canceled, and Additional Charges for cancellation shall be incurred.

12 Unit of Time for the Provision of Service

12.1 The standard unit of time for the provision of Service is a calendar month. A calendar month is each of the twelve named periods into which a year is divided (January, February, March, and so on).

12.2 All charges are levied on a whole calendar month basis unless explicitly stated. A calendar month may begin before the Service Period commences or end after the Service Period concludes. In such cases, unless explicitly stated in writing, charges shall not be pro-rated.

13 Schedule of Service and Agreement Changes and Cancellation

13.1 Service is available for regular use during the Service Period specified in the Schedule of Service and Agreement.

13.2 The Customer can request a change or cancellation to the Schedule of Service and Agreement by notifying LJC by the communication methods specified in the Schedule of Service and Agreement.

13.3 In cases where the Customer wishes to request a change to the Schedule of Service and Agreement, the request for the change must be made by the 20th day of the month (or the preceding business day when the 20th day is a holiday) by notifying LJC by the communication methods specified in the Schedule of Service and Agreement. The change shall be applied from the beginning of the next calendar month.

13.4 LJC, with sufficient reason, may choose to decline or delay a request from the Customer to change the Schedule of Service and Agreement.

13.5 The Customer can request cancellation of the Schedule of Service and Agreement by providing notice to LJC by the communication methods specified in the Schedule of Service and Agreement by the last day of the calendar month before. The provision of the Service, and the Monthly Price and Additional Charges where applicable, shall end at the end of the following calendar month, even if the Customer elects to end the use of the Service and return any Devices to LJC earlier.

13.6 The Schedule of Service and Agreement specifies any Additional Charges involved in changing or canceling any part of the Schedule of Service and Agreement.

13.7 LJC, without reason, can cancel the Schedule of Service and Agreement, cancel the provision of Service and immediately request the Customer return any Device. In such cases, the Customer shall only be responsible for the Monthly Price up to the end of the previous calendar month. However the Customer shall be responsible for the payment of all Additional Charges.

14 At the End of the Service Period

14.1 The Schedule of Service and Agreement specifies the Service Period.

14.2 The Customer can use the Service until the end of the Service Period unless the Schedule of Service and Agreement is canceled.

14.3
The term of this Agreement shall be stipulated in Article 14.1. Thereafter, this Agreement shall be extended automatically for successive periods of one 1 year each unless either party gives the other party notice of non-extension in writing at least thirty 30 days prior to the expiration of the original or any extended term of this Agreement.
In case of expiration, contact the Link Mobile Rental help desk by email for the expiration procedure. LJC shall confirm with the Customer by the end of the calendar month before the end of the Service Period whether they are willing to offer a new Schedule of Service and Agreement beyond the current Service Period and in the case that LJC does, LJC shall confirm whether the Customer wishes to continue.

14.4 At the end of the Service Period, if another Schedule of Service and Agreement is not in place, the Customer must follow LJC’s instructions on how to return any Device and end the use of the Service.

14.5 At the end of the Service Period, the Customer agrees to pay all Monthly Fees and Additional Charges by the instructions given by LJC. The Customer also agrees to pay any Additional Charges incurred which are notified by the Provider to LJC within the 60 day period following the end of the Service Period by the instructions given by LJC.



15 Privacy Policy

15.1 Personal information is gathered from the Customer by LJC and used for Customer support such as responding to Customer inquiries, information on procedures to use Services, etc.; Monthly Price and Additional Charge calculation and billing; prevention of unauthorized use of Services; and, preparation of statistical data for management analysis and the use of the results of such analysis.

15.2 LJC may share only the minimum amount of the Customer’s personal information with the Provider to provide the Service and ensuring the Provider is aware of the identity of the Customer using the Service on their network.

15.3 LJC may share only the minimum amount of the Customer’s personal information necessary with SoftBank Payment Service Corporation as LJC’s payment service provider to facilitate billing and payment collection procedures on LJC’s behalf.

15.4 It may be necessary for LJC or the Provider to provide the Customer’s personal information to third parties in the following circumstances:

15.4.1 To police or other administrative institutions for the prevention or investigation of crimes.

15.4.2 To a police agency, fire department, Japan Coast Guard or other relief agency to aid in search of a missing person.

15.5 When emergency calls are made using the Service, the information on the location where the emergency call is made shall be automatically made available to institutions handling emergency calls (even when caller display is blocked).

16 Court of Jurisdiction

16.1 The Customer, in case of any dispute regarding this Service, regardless of the monetary amount involved in the matter, shall agree that the dispute should be filed to the Tokyo District Courtas the court of first instance with exclusive jurisdiction.
